DMCA Policy

Overview

The Front Feed respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond promptly to notices of alleged copyright infringement that are reported to our designated agent, identified below.

If you believe that your copyrighted work has been copied or used on our website in a way that constitutes copyright infringement, please follow the procedures outlined below to submit a takedown notice.

Filing a DMCA Takedown Notice

To file a valid DMCA takedown notice, please provide our designated agent with a written communication that includes the following information, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf
  2. Identification of the copyrighted work claimed to have been infringed (e.g., a link to your original work or a description of the work)
  3. Identification of the material on our website that is claimed to be infringing, with information reasonably sufficient for us to locate the material (e.g., the specific URL(s) where the infringing content appears)
  4. Your contact information, including your name, mailing address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
Important: Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees. Please ensure that you are the copyright owner or authorized to act on the owner's behalf before filing a takedown notice.

Our Response Process

Upon receiving a valid DMCA takedown notice, we will take the following actions:

  • Remove or disable access to the allegedly infringing material promptly
  • Notify the person who posted the content (if applicable) that the material has been removed
  • Provide the poster with information on how to file a counter-notice if they believe the removal was made in error

Filing a Counter-Notice

If you believe that material you posted on our website was removed or disabled as a result of a mistake or misidentification, you may file a counter-notice with our designated agent. Your counter-notice must include the following, as required by 17 U.S.C. § 512(g)(3):

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled, and the URL where the material appeared before it was removed
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which The Front Feed may be found), and that you will accept service of process from the person who provided the original takedown notice

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the original complainant does not file a court action within 10 to 14 business days, we may restore the removed material.

Repeat Infringers

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts or access of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

A Note on Fair Use

Before submitting a DMCA takedown notice, please consider whether the use of the copyrighted material may constitute "fair use" under U.S. copyright law (17 U.S.C. § 107). Fair use permits limited use of copyrighted material without the owner's permission for purposes such as commentary, criticism, news reporting, teaching, scholarship, or research.

As a news publication, The Front Feed may use limited portions of copyrighted material — such as brief quotations, screenshots, or thumbnails — for purposes of news reporting, commentary, and criticism. Such use is generally protected under fair use doctrine. If you are unsure whether your complaint involves fair use, you may wish to consult an attorney before filing a takedown notice.
